Delhi HC allows Priya Kapur to submit late husband’s assets in sealed cover

The Delhi High Court on Thursday permitted Priya Sachdev Kapur to submit a detailed list of her late husband Sanjay Kapur’s assets in a sealed cover. The Court’s decision came after parties assured that no press statements regarding the matter would be leaked to the media.

Justice Jyoti Singh also directed that a copy of Sanjay Kapur’s Will be shared with his mother, Rani Kapur, while the original would remain with the Registrar General of the Court to maintain confidentiality, ANI reported,

The Court noted undertakings from Priya, her stepchildren Samaira and Kiaan Raj Kapur (through their mother Karisma Kapoor), and Rani Kapur that neither they nor their legal teams would issue public statements about the case.

Parties suggest stricter confidentiality measures

Strict confidentiality was demanded by Priya citing cybersecurity concerns and the possibility of misuse of highly sensitive financial information. She suggested a Non-Disclosure Agreement for everyone or the constitution of a “Confidentiality Club” with only designated lawyers and experts granted access.

The legal conflict arises out of a partition suit wherein Samaira and Kiaan Raj Kapur are seeking division of their father’s huge estate, rendition of accounts, and injunction against Priya and the rest of the family. 

While representing the children, Senior Advocate Mahesh Jethmalani questioned the title of the Will claiming that it was revealed under “suspicious circumstances” and that assets such as bank accounts, shares in companies, were almost picked clean already and had received Rs 1,900 crore. He added, “It’s not as if these people are left on the streets. I am a widow with a six-year-old child.”

Rani Kapur raises objections over trust rights

Senior Advocate Vaibhav Gaggar, appearing for Rani Kapur, expressed concerns that her rights under family trusts were undermined after Priya’s marriage. Speaking on behalf of her grandchildren, Rani said, “There’s something unholy going on. Despite repeated mails, I never received a copy of the Will.”

The matter is scheduled to be heard next on October 9, when the Court will consider the children’s plea to restrain the defendants from selling, alienating, or encumbering estate properties until the case is resolved.
